The cornerstone of every federal and state court criminal trial is the concept of proof beyond a reasonable doubt. In other words, the prosecution bears the burden of proving defendant guilty of each and every charged by proof beyond a reasonable doubt. This is the highest standard of proof, and it plays a crucial role in every criminal trial. While the importance of this concept is clear, exactly what it means is less so. Each year, the fate of tens of thousands of individuals who choose to proceed to trial is placed in the hands of a juries who are asked to apply the standard of proof beyond a reasonable doubt. Yet, in most, if not all federal criminal trials, defense counsel is prohibited from even explaining or defining the concept of proof beyond a reasonable doubt.
“Beyond a reasonable doubt” is more than just a catchphrase in the legal world. It is the gold standard for proving guilt in criminal cases. This standard requires the prosecution to demonstrate that there is no reasonable doubt in the minds of the jurors regarding the defendant’s guilt. In other words, the prosecution must establish that the evidence presented is so compelling and convincing that there is no room for rational skepticism.
This burden of proof relates to one of the other most fundamental principles of the American justice system – the presumption of innocence. At every stage of a criminal trial, the defendant is presumed innocent. Thus, the burden of proof rests entirely with the prosecution to prove the defendant’s guilt beyond a reasonable doubt. In other words, the defendant does not have to prove anything. The defendant does not have to prove that he or she is innocent.
The reason the standard is set so high in American criminal cases is to prevent the tragic miscarriage of justice that can occur when someone is wrongly convicted. Therefore, when jurors are called upon to apply the “beyond a reasonable doubt” standard, they must be convinced to a moral certainty of the defendant’s guilt. This high bar reflects society’s commitment to sparing innocent individuals from the dire consequences of wrongful convictions.
All of this sounds great. Unfortunately, in the American legal system, it is sometimes unclear if juries fully understand this quantum of proof. This is exacerbated by the fact that, as noted above, many Judges refuse to allow defense counsel to explain the “reasonable doubt” concept or to “define” it. That is unfortunate. At a minimum, defense counsel should be allowed to tell the jury that this is the highest standard of proof in our legal system.
